TimePoke - Terms of Service

Thank you for choosing TimePoke.com (“TimePoke”), the time tracking and communication web application by Cellar Labs LLC (“CellarLabs”). TimePoke is a web application to help you keep track of your time no matter what you are doing and how often you switch between different projects. TimePoke also makes it easy to take note of your activities and share messages with those you work with.

By using TimePoke you agree to be bound by the following terms and conditions (“Terms of Service”) as well as TimePoke’s Privacy Policy. Any new features or improvements are also subject to the TimePoke Terms of Service.

CellarLabs reserves the right to update and change the Terms of Service at any time and without notice. Violation of any of the terms below will result in the termination of your Account.

BY CONTINUING TO USE TIMEPOKE, YOU ARE CONFIRMING YOUR CONSENT AND AGREEMENT TO BE BOUND TO THESE TERMS OF SERVICE:

ACCOUNT TERMS

1. TimePoke users must be 13 years or older.
2. TimePoke cannot be accessed by automated means. All users must intend to use TimePoke within the Terms of Service.
3. TimePoke users must login with a valid Google Account provided by Google (http://www.google.com/accounts).
4. TimePoke users are responsible for protecting their TimePoke account credentials (Google Account). CellarLabs assumes no responsibility for users who do not protect their account credentials.
5. TimePoke cannot be used for illegal purposes. You are responsible for not using TimePoke in violation of any laws in your jurisdiction.
6. TimePoke users shall not violate the Terms of Service of any TimePoke supporting services, including, but not limited to, Google App Engine (“GAE”), Yammer, and Twitter.

PRICING

1. TimePoke offers several free features to all users but reserves the right to display advertising alongside the service. TimePoke will never charge for previously free features, but reserves the right to charge for new features.

2. TimePoke will notify users at least 30 days before changing pricing for services.

CONTENT OWNERSHIP

1. TimePoke users own any and all content posted to TimePoke. TimePoke users are also responsible for all content posted on TimePoke.

2. CellarLabs reserves the right, but is not required to, remove content that is deemed inappropriate or unsuitable at our discretion.

3. All HTML/CSS/IMAGES on TimePoke are copyrighted assets by Cellar Labs LLC. You may not duplicate, copy, or reuse any portion of these assets without express written permission from Cellar Labs LLC.

GENERAL TERMS

1. TimePoke uses 3rd party software and services extensively and is thus subject to their availability and changes in terms of service. TimePoke and CellarLabs cannot be held liable for unavailability of service or changes in terms of service, including 3rd party services.

2. TimePoke offers no guaranteed support; however users can access TimePoke’s support site at: http://getsatisfaction.com/cellarlabs/products/cellarlabs_time_poke

3. CellarLabs cannot be held liable in any way for any issues arising from errors in time recording, inability to access TimePoke, unauthorized access or changes to data, or any other error relating to TimePoke.

4. CellarLabs offers no warranties and cannot be held liable for the accuracy of time or data recorded in TimePoke, loss of data, nor any impact such an error might cause, regardless of materiality.

TimePoke - Privacy Terms

To provide the best service possible to TimePoke users, Cellar Labs LLC (“we”, “CellarLabs”, “TimePoke”) collects information like your email address, names for timers, time associated with different timers, limited login information for 3rd party services (like Yammer), user preferences, behavioral information from your use of TimePoke, etc.

Data created by TimePoke users is private and will never be revealed. However, CellarLabs reserves the right to anonymize data for reporting internally and externally (will allow us to blog about general usage of TimePoke).

We respect your privacy and will not contact you by email unless you specifically allow us. We do, however, reserve the right to contact you by email when there is a change in Terms of Service, Privacy Terms, or Pricing to TimePoke.

We will not gather information we do not need.

TimePoke reserves the right to utilize cookies for the purpose of tracking user activity on www.timepoke.com (see http://en.wikipedia.org/wiki/HTTP_cookie).

Any information sent through TimePoke to 3rd party services such as Twitter and Yammer is done only with the user’s permission and is subject to the Terms of Service and Privacy Terms of such services.

TimePoke is hosted and run on 3rd party services and networks – your data is stored and transmitted to them to serve you as a TimePoke user.

TimePoke users retain ownership of all content and data created using TimePoke. TimePoke will make every effort, but will not guarantee, to access data created using TimePoke.

CellarLabs reserves the right to sell all data associated with TimePoke in the event of a sale of the service. TimePoke users will be notified within 15 days of such an event by email.

CellarLabs makes a reasonable effort to protect TimePoke users’ data and account credentials, but the security of the accounts cannot be guaranteed.

CellarLabs cannot be held liable if users fail to protect their login credentials.

TimePoke users are encouraged to follow our blog at http://blog.timepoke.com for all updates of the TimePoke service.
